New Overtime Regulations, Minnesota Craft Brewers Guild: All Pints North

Hop Law gave a presentation about federal overtime regulations that go into effect on December 1, 2016at All Pints North in Duluth, Minnesota.  It’s likely going to impact a number of craft breweries all over the country.

The Fair Labor Standards Act (FLSA) requires that employees be paid overtime for hours worked beyond forty hours in a week. There are exceptions to the overtime rule, however, and the new rule will reduce the scope of these exceptions by essentially removing the exception for any employee that earns less than $47,476 annually – this salary threshold used to be $23,660.  Thus, the increase is expected to result in overtime for an additional 4.2 million workers.

There are additional requirements for exemptions beyond meeting the salary threshold, including an analysis of an employee’s duties and whether they fit with any of the FLSA exemptions.   All breweries should undertake a review of their overtime practices to determine what they need to do to comply with the new rule when it goes into effect on December 1, 2016.
